The Disaster Management Act 2005 -Rules 2014







G.S.R. 600(E).—In exercise of the powers conferred by section 43, read with section 75, of the Disaster Management Act, 2005 (53 of 2005), the Central Government hereby makes the following rules, namely: -
 

PART-1
Preliminary
1. Short title and commencement.-
(1) These rules may be called the National Institute of Disaster Management Employees
(Recruitment and Other Conditions of Service) Rules, 2014.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Definition.- In these rules, unless the context otherwise requires,-
(a) “Act” means the Disaster Management Act, 2005 (53 of 2005);

(b) “academic staff” means the persons appointed to the faculty posts of
(Research Associate, Assistant Professors, Associate Professors, Professors)
and Consultants;
(c)  “appointing authority” in relation to any post in the Institute, means the
authority competent to make appointment to that post.
(d) “borrowed employee” means an employee of any authority whose services
are obtained by the Institute on loan;
(e) “employee” means a person serving in the Institute in any sanctioned post of
the Institute;
(f) “foreign service” means service for which an employee received with the
approval of the appointing authority, his pay from any source other than the
funds of the Institute;
(g) “Institute” means the National Institute of Disaster Management constituted
vide notification of the Government of India in the Ministry of Home Affairs
number S.O. 1862€, dated the 30
th
 October, 2006 ;
(h) “pay” means the pay admissible on the relevant date and includes special pay
and personal pay as well as deputation allowance in case of borrowed
employees but does not include any other allowances, fee or honorarium;
(i) “permanent post” means a post carrying a definite rate of pay sanctioned
without limit to time;
(j) “regular service” in relation to any grade means the appointment to a
sanctioned post according to prescribed procedure and after completion of
probation; 
(k) “sanctioning authority” means -
(i) in relation to Group A posts; the Central Government;
(ii) in relation to Group B and C posts; the Executive Director;
(l) “schedule” means a schedule to these rules;
(m) “temporary employee” means the service of a temporary employee in a
temporary post or officiating service in a permanent post;
(n) “temporary  post” means a post carrying a definite rate of pay for a limited
time;
(o) “governing  body” means the Governing Body of the Institute constituted
under sub-section(4) of Section 42 of the Disaster Management Act, 2005.

PART- II
TERMS AND CONDITIONS FOR RECRUITMENT
3. Name, number of posts, classification, etc..–The name, number, classification, pay band and grade
pay of various categories of posts in the Institute shall be as specified in columns (1) to (4) of the schedule.
4.  Method of recruitment, age-limit and other qualifications etc. .-The method of recruitment, agelimit,

qualifications and other matters connected thereto shall be as specified in columns (5) to (13) of the
Schedule.
5.  Initial Constitution.-
(1) All employees appointed to various posts in regular pay band and grade pay shall be deemed to
have been appointed under these rules to the respective posts with effect from the date of their
service in the Institute.
