ORDER
The Government of India enacted Act.No.20/2013 i.e., National Food
Security
Act, 2013. According to Section 14 to 18
of the NATIONAL FOOD SECURITY ACT,
2013, State government has to establish
/ appoint the internal grievance redressal
mechanism, District Grievance Redressal
Officer, State Food Commission and as per section 29 of the Act, constitute the
Vigilance Committees at State to FP Shop level to supervise the implementation
of all schemes and to inform the District Grievance Redressal Officer about any
malpractices/ misappropriations etc
2. In the reference sixth read above,
the Director to the Govt. of India, Ministry of
Consumer Affairs, Food & P.D.,
Department of Food & Public Distribution, New Delhi
has stated that setting up of Grievance
Redressal Machinery (GRM) is vital for proper implementation of the Act and
therefore, pending finalization of Rules, alternative arrangements for
grievance redressal, as per provisions of the Act, should be put in place.
3. The Registrar, APSCDR Commission,
A.P. Hyderabad in the reference 6th read
above, has informed that the President,
APSCDRC has agreed to designate the
APSCDRC as State Food Commission under
section 18 of the National Food Security Act, 2013, (Act.No.20 of 2013) as
stop-gap arrangement till finalization of Rules .
4. After careful consideration of the
entire issue by the Government, the State
Government implementing the National
Food Security Act,2013 in the State of Andhra Pradesh with effect from 1st April, 2015. Rice is
being supplied to the BPL cardholders as per the norms indicated in the NFS
Act, 2013 at Re.1-00 per kg. Accordingly, initiated action for establishment of
State Food Commission, Issue of Rules under the said Act, and other statutory
provisions wherever necessary. Keeping in view the administrative delay in
processing the issues, instructions from the Government of India and also the
need /necessity of alternate designatories for implementation of the Act in the
State. It is decided to make the following alternative arrangements for
disposal of grievances as per the National Food Security Act, 2013 till establishment
/ appointment of grievance redressal mechanism as mentioned in the Act, 2013.
i) The
Joint Collector, shall perform the functions of the Dist.
Grievance Redressal Officer as prescribed under section 15 of
the
National Food Security Act, 2013.
ii) The
District Supply Officer, who is now looking the Civil Supplies matters
shall assist the Jt. Collector in
disposal of the grievances. DGRO shall ensure
the disposal of the grievance within 15
days from the date of receipt of the
complaint in the office of DGRO.
However, no grievance shall be kept with the
DGRO more than 30 calendar days without
redressal.
iii) The
Tahsildar at Mandal level, the Revenue Divisional Officer at
Division level designated as nodal officer. The Tahsildar and
Rev.
Divisional Officer concerned shall perform the functions as per
the
provisions of the N.F.S. Act, 2013 Entitlements,
responsible authority,
supervisory/nodal officer with whom the
grievance to be filed and the appellate
authority are as give under :
5. The State Commission constituted
under the Consumer Protection Act, shall
also perform the duties of State Food
Commission as mentioned under the National
Food Security Act, 2013, with its office
staff, till constitution of the State Food
Commission by the State Government, for
the purpose of monitoring and review of
implementation of the Act 2013.
6. The nomenclature of the Food Advisory Committees shall be changed as
“Vigilance Committees”. The Food Advisory committees constituted
at various
levels i.e., Ration shop, ward/village,
municipality/Corporation/mandal, district
and state levels shall also perform the functions as prescribed
under Section 29 of the National Food Security Act, 2013, in addition to the
functions as assigned to them in accordance with the Public Distribution
Systems (Control) Order 2001, made under the Essential Commodities Act, 1955,
and as amended from time to time. The above
arrangements shall be in force till issue of further orders.
7. The Commissioner of Civil Supplies,
A.P. Hyderabad, is requested to take
necessary action immediately.
