ORDER:

             Whereas, by virtue of section 3 of the Andhra Pradesh Reorganization Act, 2014 (Central Act No. 6 of 2014), the State of Telangana comprising territories specified therein has been formed on and from the appointed day i.e., of 02-06-2014;

2.        And whereas, in section 101 of the Andhra Pradesh Re-organization Act, 2014, a provision has been made for the purpose of facilitating the application of any law (as defined in section 2 (f) of the Act), made before the appointed day, in relation to the State of Andhra Pradesh or the State of Telangana, the appropriate Government may before expiration of two years from 02-6-2014, by order, make such adaptations and modifications of the Law, whether by way of repeal or amendment, as may be necessary or expedient, and thereupon every such law shall have effect subject to the adaptations and modifications so made until altered, repealed or amended by a competent Legislature or other competent authority;

3.     And whereas, the Andhra Pradesh Police (Stipendiary Cadet Trainee) Rules, 1999 made in exercise of the powers conferred by the proviso to Article 309 of the Constitution of India, vide G.O., 1st read above, are in force as on 01-06-2014;
 
4.         Now therefore, the Government after careful examination of the matter, hereby decided to adapt the said Andhra Pradesh Police (Stipendiary Cadet Trainee) Rules, 1999 as in force on 01-06-2014 with certain modifications.

5. Accordingly, the following notification will be published in an Extra ordinary Issue of the Telangana State Gazette, dated 04 -01-2016.

NOTIFICATION
In exercise of the powers conferred by section 101 of the Andhra Pradesh Re-organization Act, 2014 (Central Act No.6 of 2014), the Government of Telangana hereby order for adaptation of the Andhra Pradesh Police (Stipendiary Cadet Trainee) Rules, 1999 as in force on 01-06-2014 to the State of Telangana and makes the following order namely:-
1.
(i)
This order may be called – The Andhra Pradesh Police (Stipendiary Cadet Trainee) Rules, 1999 (Telangana Adaptation) Order, 2015.

(ii)
It shall be deemed to have come into force with effect from 02-06-2014.
2.
In the Andhra Pradesh Police (Stipendiary Cadet Trainee) Rules, 1999  

(i)
throughout the rules, for the words “ Andhra Pradesh”, wherever occurs the word “Telangana” shall be substituted except the expression “Andhra Pradesh Public Employment (Organization of Local Cadres and Regulation of Direct Recruitment) Order, 1975”.

(ii)
throughout the rules, for the words “ Andhra Pradesh Police Academy”, wherever occurs the word “RBVRR Telangana State Police Academy” shall be substituted.

(iii)
throughout the rules, the words “Srikakulam, Vizianagaram, Visakhapatnam, East Godavari and West Godavari districts” wherever occurs shall be omitted.

For rule 2, the following shall be substituted, namely:-

Constitution:
   This service shall consist of the following classes and categories of posts:

Class-I: (Men & Women)

Category: (1) Stipendiary Cadet Trainee Sub-Inspector of Police (Civil)
                (2) Stipendiary Cadet Trainee Police Constable (Civil)
           
Class-II: (Men & Women)

Category: (1) Stipendiary Cadet Trainee Reserve Sub-Inspector of Police (AR)
                (2) Stipendiary Cadet Trainee Police Constable (AR)

Class – III: (Men)

Category: (1) Stipendiary Cadet Trainee Reserve Sub-Inspector of Police (SAR  
                      CPL)
                (2) Stipendiary Cadet Trainee Police Constable (SAR CPL)

Class-IV: (Men)

Category: (1) Stipendiary Cadet Trainee Reserve Sub-Inspector of Police (TSSP)
        (2) Stipendiary Cadet Trainee Police Constable (TSSP)

Class – V (Men & Women):

Category: (1) Stipendiary Cadet Trainee Sub-Inspector of Police   
                     (Communications).
  1.         (2) Stipendiary Cadet Trainee Police Constable (Communications)
 
Class – VI (Men):

Category: (1) Stipendiary Cadet Trainee Sub-Inspector (Police Transport  
                      Organization).
       (2)  Stipendiary Cadet Trainee Police Constable (Mechanic) (Police  
             Transport Orgn.)
        (3) Stipendiary Cadet Trainee Police Constable (Driver) (Police  
             Transport Orgn.).

Class - VII (Men and Women):

Category:   Stipendiary Cadet Trainee Asst. Sub-Inspector (Finger Print Bureau)

The Class and categories of posts mentioned in rule 2, wherever occurs throughout the rules shall be read as in rule 2 against the posts”.

In rule 3,

(i)
“for rule 3 (B), the following shall be substituted, namely:-


“3(B)
Vacancies:- (i) All substantive vacancies as well as the vacancies that are likely to arise up to the 1st September of the year for which notification for recruitment is issued shall be taken into account for that particular recruitment.



(ii) 33 1/3% of vacancies in each category are reserved for women in vacancies which arise after issue of this notification for the Posts of SIs (Civil), PCs (Civil), SIs (Communications), PCs (Communications) and ASIs (FPB). In the event of non-availability of eligible and suitable women candidates in a particular year, the vacancies reserved for them shall not be carried forward to the subsequent year and shall be filled up by men candidates of respective category. The reservation will be a horizontal reservation following principle of sufficiency i.e., the reservation of women candidates shall be adjusted proportionately in the respective category to which the women candidate belongs, in relaxation of relevant rules relating to Andhra Pradesh State and Subordinate Service Rules.






(iii) 10 % of vacancies in each category are reserved for women in vacancies which arise after issue of this notification for the Posts of RSIs (AR) and PCs (AR). In the event of non-availability of eligible and suitable women candidates in a particular year, the vacancies reserved for them shall not be carried forward to the subsequent year and shall be filled up by men candidates of respective category. The reservation will be a horizontal reservation following principle of sufficiency i.e., the reservation of women candidate shall be adjusted proportionately in the respective category to which the women candidate belongs, in relaxation of relevant rules relating to Andhra Pradesh State and Subordinate Service Rules.”

 (ii)
“for rule 3 (C), the following shall be substituted, namely:-


“3(C)(i)
a) The Rule of representation (reservation) provided in rule 22 and 22 A of the State & Subordinate Service Rules, as applicable to the State of Telangana, shall be applicable to all the classes and categories constituted in rule 2.



b) The vacancies reserved for special categories referred to in rule – 3 (D) shall be adjusted in a horizontal manner i.e., the reservation of Special Category candidates shall be adjusted proportionately in the respective communal category to which the  candidate belongs.


(ii)
The rule of representation (reservation) provided in rule 22 of the State & Subordinate Service Rules, as applicable to the State of Telangana, shall not be applicable in the following cases:-



a) 75% vacancies in the Scheduled Areas of the State of Telangana of Stipendiary    
   Cadet Trainee Police Constable (Civil).



b) All vacancies of Stipendiary Cadet Trainee Police Constable  
  (Communications) (Men and Women) in the 15th Bn., TSSP (deputation)”

(iii)
rule 3 (H) shall be omitted.
5.

In rule 6, after sub-rule (iii) the following sub-rule shall be added namely:-



“(iv) A cadet who remains absent for a total period of (7) days shall be discharged  
      from training after issuing notice and obtaining explanation.



(v) The appeals can be made within a period of ( 30 ) days from the date of acknowledgment of the discharge orders. Appeals preferred after the prescribed period shall not be entertained.  This condition must be incorporated in the discharge order”.

After rule (7), the following proviso shall be added, namely: -



“Provided that in the event the employee of the Police Department gets selected to any other Central Governments/State Government or Quasi-Government Organization or another public Enterprise, before completion of the above stated Bond period, he/she need not refund the security bond amount and he/she can be relieved and join the new service, subject to condition that fresh bond is taken to ensure that the employee serves any of the government organization or public enterprise as mentioned above for the balance of the original bond period.”

The existing Annexure I of rule 3 shall be substituted with Annexure-I of this order.  
8.

The existing Annexure II shall be substituted with Annexure-II of this order.  
9.

The existing Annexure III shall be substituted with Annexure-III of this order.  
10

Annexure X shall be omitted.
