In the G.O 1st read above, orders were issued according permission to
Satya Academy of Technical Education, Guntur to start BSc (Nursing) course of 4
years duration in Satya Institute of Medical Education and Research (SIMER)
College of Nursing , Lalpuram Road, Guntur.
2. In the letter 2nd read above, the Registrar, Dr.NTRUHS, Vijayawada has informed
that, number of allegations were received from the students against the
management of Satya Academy of Technical Education, Guntur about certain kind
of irregularities happened at the college. He has also stated that the
University conducted inspection and enquired the matter and found that Satya
Academy of Technical Education, Guntur is not suitable to impart training among
others to B.Sc.(Nursing) students in all aspects like providing teaching and
clinical facilities and in view of other kind of complaints.
3. He has further reported that the entire matter was placed before the
Executive Council of the University and the Council after thorough examination
of the whole issue, unanimously resolved in its 215th Executive Council meeting dated;13.02.2015 to disaffiliate various colleges under SIMER (Satya Academy
of Technical Education), Guntur and to distribute the existing students into
other colleges.
4. In pursuance of the Executive Council
resolution, Satya Institute of Medical Education
and Research (SIMER) College of B.Sc.
Nursing, Guntur which was established by Satya Academy of Technical Education,
Guntur was disaffiliated among others from the University with immediate effect
vide letter dated.31.03.2015 and it was
resolved that in due course, the existing students would be accommodated in nearby colleges.
5. The Registrar, Dr.NTRUHS has requested
the Government to arrange to cancel the Essentiality Certificate issued to
Satya Institute of Medical Education and Research (SIMER) College of Nursing,
Lalpuram Road, Guntur established by
Satya Academy of Technical Education, Guntur and arrange to intimate the
same to Dr.NTRUHS.
6. The Government after careful
consideration of the whole issue and the
proposal of Registrar,
Dr.NTRUHS to cancel the Essentiality
Certificates issued to the following college established by Satya Academy of
Technical Education, Guntur in view of the unanimous Resolution of the 215th Executive Council meeting of Dr.NTRUHS held on 13.2.2015, has ordered for
cancellation of the Essentiality Certificate issued to
SIMER in G.O.Ms.No.358, HM&FW (K2) Deptt, dated:30.09.2004, Satya
Academy of Technical Education, Guntur
was permitted to start B.Sc. Nursing course in Satya Institute of Medical Education
and Research (SIMER) College of Nursing,
Lalpuram Road, Guntur in the G.O
3rd read above.
7. The Director of Medical Education, AP and
the Registrar, Dr. NTRUHS were also instructed in the aforementioned G.O to
take necessary action to accommodate the
students who are pursuing BPT, B.Sc (MLT) and B.Sc (N) courses in the
nearby colleges duly following the procedure in vogue.
8. Aggrieved by the above orders, the
management of SIMER approached Hon’ble High Court by filing WP No.14255 and 17765/2015.
The Hon’ble APHC has delivered judgment dt 28.07.2015 in the above
referred WP No. 14225 and 17765 of 2015. The relevant portion of the common
order is extracted below:
This
Court also perused G.O.Ms.No.57, Health, Medical & Family Welfare (C2)
Department, dated 10.06.2015, which is almost a replica of the order of the
University dated 31.03.2015. The Government appears to have passed the said
order without giving any notice, merely based on the report submitted by the
respondent University. The order of permissions granted in G.O.Ms.Nos.656 and
657, dated 07.11.2003 contain the safeguard of fifteen days notice for showing
cause against cancellation of permission and it reads as follows:
“In the circumstances,
the impugned order in proceedings No.6905/A5/Nsg/04 dated 31.03.2015 passed by
the respondent University, and G.O.Ms.No.57, Health, Medical & Family
Welfare (C2) Department, dated 10.06.2015, are set aside, but, giving liberty
to the respondent University to issue a fresh show cause notice with specific
charges in respect of each college specifically alleging the grounds of
irregularities and serve the same on the respective colleges within a period of
fifteen days from the date of receipt of a copy of this order. It is open to
the respective colleges to submit their explanation within a period of fifteen
days from the date of receipt of the show cause notice, and, after receipt of
explanation within the time specified, the respondent University shall consider
the explanation with the available material on record and pass a final order in
respect of each college within thirty days thereafter.
Independent of the above
procedure, the first respondent shall issue appropriate show cause notice to
the petitioner, who is running three colleges, if the first respondent wants to
cancel the Essentiality Certificates, and give sufficient time to the
petitioner for submitting its explanation. After considering the explanation, the
first respondent shall take an independent decision by considering the
explanation as well as the report of the University and pass appropriate orders
thereon.
Both the Writ Petitions
are allowed subject to the course of action indicated above. The status quo
order granted by this Court on 07.05.2015 shall continue till the date of
passing of final orders by the University and the Government. The miscellaneous
petitions pending, if any, shall stand closed.
There shall be no order as to costs.”
9. In the letter 5th read above,
the Registrar, Dr.NTRUHS, Vijayawada has reported that the inspection committee
appointed by the University has noticed the following deficiencies/lapses/ irregularities in respect
of SIMER College of B.Sc.M.L.T., Guntur.
I. Deficiencies observed with regard to faculty:
a)
Only
2-3 faculty are found to teach all the students (1 M.Sc.(N); 1 B.Sc(N) & 1
M.Sc.(Micro) for all 3 programmes in B.Sc.(N), B.Sc(MLT) and BPT).
b) Professor cum
Principal – Fresher with 1 year experience and No other faculty. Management
people, Director and Correspondents are taking the classes.
c)
No
Librarian
d)
Students
have clearly stated that they are preparing for exams on their own.
II. Deficiencies observed with regard to infrastructure:
a)
B.Sc.(Nursing),
B.Sc.(MLT) and BPT are in same building
b)
Maintenance
of building is very poor and not ideal
c)
Own
building, but the management is not able to provide the necessary documents
required by the University.
d)
Sanitation
facilities are not good.
e)
No
provision for safe drinking water, adequate water, students are buying water
for drinking and domestic purpose.
f)
No
boys hostel.
g)
No
proper plan for any programme
h)
No
power supply to the entire college building and it is found that the electrical
wires are disconnected.
i) No Med net facilities in Library.
j) Conditions of the
Labs, class rooms, Principal room, hostel and
the surroundings are very unhygienic and
not properly
maintained.
k) They are paying extra amount (Rs.500/- to
Rs.1000/-) as per
community
basis regarding mess apart from their scholarship
amount.
III.
Deficiencies
observed with regard to Clinical Training:
a)
No
Rural Community and Urban Community centre attached to the Institute in
addition to the 200 bedded hospital facilities.
b)
Demonstration
room is not equipped with 10 beds and there is no wash basin.
c)
During
Enquiry, students revealed that since two years, they are not going to any
other hospital.
IV.
Deficiencies observed
with regard to Labs:
a)
Lab
equipment, Linen not yet replaced.
b)
No
separate labs for Microbiology, Pathology and Biochemistry Departments.
c)
No
separate labs for B.Sc.(MLT) and BPT courses.
10. Government after careful examination of the
matter, has observed that the management
has failed to follow the conditions
stipulated in G.O.Ms.No.358, HM&FW (K2) Deptt,
dated:30.09.2004 wherein permission was accorded to Satya Institute of
Medical Education and Research (SIMER) College of Nursing and therefore hereby direct
the Management of Satya Academy of Technical Education, Guntur to show cause as to why the permission
accorded to the Management of Satya Institute of Medical Education and Research
(SIMER) College of Nursing, Guntur should not be cancelled and students of the
said institute shall be shifted to other
institutions in view of the deficiencies/lapses/irregularities pointed out by the inspection committees.
11.
If no reply is received with in 15
days of time from the date of receipt of this notice, it will be construed that
the Management has no reply / explanation to offer and further action will be
taken as per rules in force.

2-3 faculty are found to teach all the students (1 M.Sc.(N); 1 B.Sc (N) & 1
M.Sc.(Micro) for all 3 programmes in B.Sc.(N), B.Sc (MLT) and BPT).

Professor
cum Principal – Fresher with 1 year experience and No other faculty. Management
people, Director and Correspondents are taking the classes.

Librarian
h) Students
have clearly stated that they are preparing for exams on their own.
II. Deficiencies observed with regard
to infrastructure:
i) B.Sc.(Nursing),
B.Sc.(MLT) and BPT are in same building
j) Maintenance
of building is very poor and not ideal
k)
Own
building, but the management is not able to provide the necessary documents
required by the University.
l) Sanitation
facilities are not good.
m)
No
provision for safe drinking water, adequate water. Students are buying water
for drinking and domestic purpose.
n) No
boys hostel.
o) No
proper plan for any programme
p)
No
power supply to the entire college building and it is found that the electrical
wires are disconnected.
i) No Med net facilities in Library.
j) Conditions of the Labs, class rooms,
Principal room, hostel and the
surroundings
are very unhygienic and not properly maintained.
k) They are paying extra amount (Rs.500/-
to Rs.1000/-) as per
community basis regarding mess apart
from their scholarship
amount.
III.
Deficiencies
observed with regard to Clinical Training:
g)
No
Rural Community and Urban Community centre attached to the Institute in
addition to the 200 bedded hospital facilities.
h)
Demonstration
room is not equipped with 10 beds and there is no wash basin.
i)
During
Enquiry, students revealed that since two years, they are not going to any
other hospital.
IV.
Deficiencies
observed with regard to Labs:
g)
Lab
equipment, Linen not yet replaced.
h)
No
separate labs for Microbiology, Pathology and Biochemistry Departments.
i)
No
separate labs for B.Sc.(MLT) and BPT courses.
10. Government after careful examination of the
matter, has observed that the management has failed to follow the conditions
stipulated in G.O.Ms.No.656, HM&FW (K2) Deptt,
dated:07.11.2003 wherein permission was accorded to Satya Institute of
Medical Education and Research (SIMER) College of Physiotherapy and therefore
hereby direct the Management of Satya Academy of Technical Education,
Guntur to show cause as to why the
permission accorded to the Management of Satya Institute of Medical Education
and Research (SIMER) College of Physiotherapy, Guntur should not be cancelled
and students of the said institution shall be shifted to other institutions in view
of the deficiencies/lapses/irregularities pointed out by the inspection committees.
11.
If no reply is received with in 15
days of time from the date of receipt of this notice, it will be construed that
the Management has no reply / explanation to offer and further action will be taken
as per rules in force.
