(Pension-cum-Gratuity) Rules, 1980 – Amendments – Final Notification – Issued.

AGRICULTURAL MARKETING AND COOPERATION (AM.III) DEPARTMENT G.O.Ms.No.36 Dated 30- 03-2013.

Whereas in exercise of the powers conferred by sub section (1) and sub-section

(2) (iv) of section 33 of the Andhra Pradesh (Agricultural Produce and Livestock) Markets Act, 1966 (Act 16 of 1966), a preliminary notification has been issued vide reference 4th read above, for making amendment to rules 5, 6 & 11 of the Andhra Pradesh Market Committee Employees (Pension-cum-Gratuity) Rules, 1980 and the same has been published in the Extra ordinary Issue of the Andhra Pradesh Gazette dated 11.12.2012 inviting objections/suggestions within one month from the date of publication of the Notification;

2. And whereas, no objections/suggestions have been received by the Government/Commissioner & Director of Agricultural Marketing, Andhra Pradesh, Hyderabad within the prescribed time limit;

3. Now, Government have decided to issue the following final notification and the same will be published in the Extra Ordinary Issue of the Andhra Pradesh Gazette dated 01.04.2013:- FINAL NOTIFICATION

In exercise of the powers conferred by under sub-section (1) read with sub section 2(iv) of Section 33 of the Andhra Pradesh (Agricultural Produce and Livestock) Markets Act, 1966 (Act.No.16 of 1966), the Government of Andhra Pradesh hereby makes the following amendments to the Andhra Pradesh Market Committee Employees (Pension-cum-Gratuity) Rules, 1980 issued in G.O.Ms.No.444, Food and Agriculture (Agri.IV)Department, dated 18.08.1980 and published in issue No.38 of R.S. to Part-1, Extraordinary of the Andhra Pradesh Gazette, dated 05.09.1980 as required under subsection (4) of section 33 of the said Act.

AMENDMENTS

In the said rules,

(1) for rule 5, the following shall be substituted namely :-

“ 5. Every Market Committee shall contribute 10% of its

income towards the Andhra Pradesh Central Market

Employees (Pension-cum-Gratuity) fund to be maintained by

the Director of Marketing for the payment of pensions to the retired Market Committee Employees, who were appointed prior to 31st August, 2004:

Provided that Central Pension-cum-Gratuity Fund shall

be contributed by the Market Committee before 5th of every

month with the schedule of payment to the Director of

Marketing: Provided further that the Agricultural Market

Committee employees appointed on or after 1st September,

2004 shall com under the ‘Contributory Pension Scheme,

2004:”

(2). rule 6 and rule 11 shall be omitted.

(4) This order shall come into force with immediate effect and shall be reviewed after five (5) years.
