It has been
brought to the notice of Government by the Investigating
Agency in the
reference 1st read above, the Anti Corruption Bureau,
that Sri K.
Kumar Goud, Dy.
E.E.(I/c), APEWIDC, Hyderabad and working as I/c Dy.E.E.
Jawaharlal Nehru
National Urban Renewal Mission Wing, GHMC, RangaReddy
Division-I,
Hyderabad, on deputation has acquired assets disproportionate to
his known sources
of legal income in his name and in the names of his family
members and a
case in Cr.No.17/ACB-CR/2011 U/Sec.13(2) r/w 13 (1) (e) of
P.C. Act, 1988 of
ACB, City Range-II Hyderabad was registered on 27.08.2011
and investigated
into matter. The individual was placed under suspension by
the Managing
Director, Andhra Pradesh Education & Welfare Infrastructure
Development
Corporation, Hyderabad vide reference 2nd read
above, and
thereafter
permission was accorded for his reinstatement into service vide
reference 3rd read above. The MD, APEWIDC, vide
reference 4th read above,
reinstated the
individual into service.
2. In the
reference 5th read above, the Director General, Anti
Corruption
Bureau,
Telangana, Hyderabad, in his final report, has stated that the Accused
Officer is found
in possession of assets disproportionate to his known source of
legal income to
the tune of Rs.6,78,000/- which comes to 5.7% of the total
income of
Rs.1,18,97,499/- for which the Accused Officer could not account for
satisfactorily.
The percentage of disproportionate assets of Accused Officer falls
below 20% margin
allowed as per the orders in Memo No.623/SPL.C/2008-2,
dt.15-10-2008 of
the Government. Hence, the allegation of possession of
disproportionate
assets to the known source of his income is held not
substantiated
against the Accused Officer. Further, the Accused Officer not
obtaining prior
permission from the competent authority for acquisition of
immovable and
movable properties in his name and in the names of his family
members and also
failure to submit Annual Property Returns to the Competent
Authority is
concerned, the disproportionate asset case was registered against
the Accused
Officer on 26-08-2011 and the searches were conducted on
28.08.2011 and
the check period was taken from 03.04.1987(date of entry into
the Govt.
service) to 28.08.2011(date of search in the AO’s house). The APCS
(CC&A) Rules
1991 have been adopted in the APEWIDC w.e.f.04.07.2013,
therefore, the
APCS(CC&A) Rules are not applicable to the Accused Officer
during the check
period of this case, as such no departmental action is
recommended
against the Accused Officer for violation of Conduct Rules.
3. Government,
after careful examination of the matter in detail, have
decided to accept
the above recommendation of Director General, ACB,
Telangana,
Hyderabad and to drop further action relating to ‘possession of
disproportionate’
assets case initiated and violation of conduct rules against
Sri K. Kumar
Goud, Dy. E.E.(I/c), APEWIDC, Hyderabad and at present
working as I/c
Dy.E.E. Jawaharlal Nehru National urban Renewal Mission
Wing, GHMC,
RangaReddy Division-I, Hyderabad on deputation.
4. Accordingly,
Government hereby drop further action against Sri K. Kumar
Goud, Dy.
E.E.(i/c), APEWIDC, Hyderabad and at present working as I/c
Dy.E.E.
Jawaharlal Nehru National urban Renewal Mission Wing, GHMC,
RangaReddy
Division-I, Hyderabad on deputation, in respect of the possession
of
disproportionate assets and violation of APCS(CC&A) Rules,1991.
5. The MD,
APEWIDC, Hyderabad shall take necessary action accordingly in
the matter.

Whereas,

Government that certain District Educational Officers working in various

of the State failed to file Counter Affidavits in the pending OAs, before
Hon’ble

Whereas, Government after examining the matter, in the G.O. 2nd read above

Sri K. Lingaiah, while working as DEO, Karimnagar District for exhibiting
slackness
and negligence towards his legitimate duties and directed him to submit
his
written statement of defence admitting or denying Article of Charge framed
against
him.

Whereas, in the reference 3rd read above, the Commissioner & Director of
School
Education, Telangana, Hyderabad, while narrating the Written Statement of
Defence
submitted by the Sri K. Lingaiah, the then District Educational Officer,
Karimnagar
reported that the individual has taken appropriate steps to file Counter
Affidavits
in the OAs and thus, his written statement of defence denying the charge
is
convincing and therefore, requested the Government to issue word of caution and
drop
further action against Sri K. Lingaiah, the then District Educational Officer

ORDER
:
Whereas,
in the reference 1st read
above, it was brought to the notice of the
Government
that certain District Educational Officers working in various districts
of
the State failed to file Counter Affidavits in the pending OAs, before Hon’ble
APAT,
which lead to personal appearance of the Commissioner and Director of
School
Education in the said cases even though clear instructions have been issued
to
them to file Counter Affidavits in all the pending OAs promptly.
2.
Whereas, Government after examining the matter, in G.O. 2nd read above
initiated
Departmental Proceedings under Rule 20 of the AP CS (CC&A) Rules, 1991
against
Sri A.Subba Reddy, while working as D.E.O, Hyderabad District for
exhibiting
slackness and negligence towards his legitimate duties and directed him
to
submit his written statement of defence admitting or denying Article of Charge
framed
against him.

Whereas, in the reference 3rd read above, the Commissioner & Director of
School
Education, Telangana, Hyderabad, while narrating the Written Statement of
Defence
submitted by the Sri A.Subba Reddy, the then District Educational Officer,
Hyderabad
reported that the individual has taken appropriate steps to file Counter
Affidavits
in the OAs and thus, his written statement of defence denying the charge
is
convincing and therefore, requested the Government to issue word of caution and
drop
further action against Sri A.Subba Reddy, the then District Educational
Officer,
Hyderabad.

And, whereas, Government after examining the matter, decided to drop
further
action against Sri A. Subba Reddy, the then DEO, Hyderabad District, at
present
working as Dy. Director, Model Schools, O/o DSE, T.S. Hyderabad.
5.
Accordingly, Government hereby drop further action against Sri A.Subba
Reddy,
the then District Educational Officer, Hyderabad District, at present
working
as Dy. Director, Model Schools, O/o DSE, T.S. Hyderabad and warn him to
be
careful while discharging his duties.
5.
The Director of School Education, Telangana, Hyderabad shall take necessary
action
accordingly.
