ORDER :

The following notification will be published in an Extra-Ordinary issue of the Andhra Pradesh Gazette and in the District Gazettes of Srikakulam, Visakhapatnam, East Godavari and West Godavari, Krishna, Guntur, Prakasam and Pottisriramulu Nellore dated 10-07-2015.

NOTIFICATION

In exercise of the powers conferred by section 33,34,46,47 and 48 of the Indian Ports Act, 1908 (Central Act of 15 of 1908) read with the Indian Ports (A.P. Amendment) Act, 1968 (Act. No. 18 of 1968) and in suppression of all the previous notifications issued on the subject, the Governor of Andhra Pradesh hereby directs as follows:

(i.) that, after the expiry of Sixty (60) days from the day on which this notification is published in the Andhra Pradesh Gazette and also in the District Gazettes of Srikakulam, Visakhapatnam, East Godavari and West Godavari, Krishna, Guntur, Prakasam and Pottisriramulu Nellore, the rates of Port Dues to be levied on vessels, specified in Col.(4) of the schedule below entering at Intermediate and Minor Ports in Andhra Pradesh under the direct control of AP Port Department subject to the provision s of clauses (iv) to (viii) below:

(ii.) that, such dues shall be levied subject to the conditions mentioned in Col.(5) of the schedule below and explanations given there under:

(iii.) that, for the purpose of levy, each Port shall be a unit by itself.

(iv.) that, the rates of Port dues chargeable on any vessel entering a Port in ballast and not carrying passengers shall be three fourths (3/4th) of the rates specified in the schedule below:

(v.) that, when a vessel enters a Port, but does not discharge or take in any cargo or passengers therein with the exception of such unshipment and reshipment (as may be necessary for the purpose of repairs) shall be charged with Port dues at half the rates specified in the schedule for every thirty (30) days. 

(vi.) that, when a vessel, having called at a Port during a voyage re-enters the same port for taking in or discharging any passengers or cargo, shall be charged Port dues at the rates, specified against Sl.No.(2) in Col.(4) of the schedule below, and in case port dues for the said vessel has already been collected at the rates specified against S.No.(1) in Col.(4) of the schedule below, the port dues leviable on re-entry of the said vessel shall be the difference between the rates specified against Sl.No.(2) in Col. (4) of the schedule below, the port dues leviable on re-entry of the said vessel shall be the difference between the rates specified against S.No.1 and 2 in Col. (4).

(vii.) that, no port dues shall be levied on:

(a) any pleasure yacht; or

(b) any vessel which having left any port is compelled to re-enter it, by stress of weather or in consequence of having sustained any damage; or

(c) any vessel which having entered by port, leaves it within 48 hours, without discharging or taking in any passengers or cargo; and

(d) any vessel waiting for Berth at Deep Water Port, Kakinada up to 48 hours only.

(e) any vessel awaiting turn for STS operation at Kakinada Port up to 48 hours only.

(viii.) that, when foreign fishing vessels apprehended by coast guard/Navy are brought into the port for interrogation, no port dues shall be levied on such vessels.


EXPLANATION

(1.) “Ship” means a vessel propelled solely by wind power.

(2.) “Steamer” means any vessel other than a ship.

(3.) “Port dues” mentioned in the above schedule are chargeable for a Sea going vessels of 15 tons and upward capacity vessels.

(4.) “Coasting ship” or “Coasting Steamer” means respectively a ship or steamer which at any Port in India and Coasting steamer includes a coasting steam vessel.

(5.) “Foreign Ship or Foreign Steamer” means respectively a ship or steamer not being a coasting ship or coasting steamer. 

This order issues with the concurrence of Finance (EBS.XI) Department vide their U.O.No.4493/23/EBS.XI/A2/15, dated 13-05-2015 and Law (H) Department vide their U.O.No.830/1/H/2015, dated 02-06-2015.
