Read the Following:
1. Hon’ble High Court Orders dated:31-08-2015 in PILNo.206 of 2015 filed by Secretary, Animal Rescue Organization and another.
2. From Prl. Secy, AHDD&F., D.O.Lr.No.3383/AH.I/A3/2015, dated 16.09.2015

ORDER:
In the reference first read above, the Hon’ble High Court in its order
dated 31.08.2015 among other things has directed the respondent No.1 (i.e C.S. to
Govt., A.P.) to convene a meeting of all the departments concerned in this behalf
and prepare a comprehensive action plan to prevent cruelty to animals in
transit.
2. In pursuance of the orders dated:31-8-2015 of AP High Court in Pil No.206
of 2015, Chief Secretary has convened a meeting on 14-9-2015 at 11-30 AM with
all the concerned at Conference Hall. As per the decisions taken in the
meeting, a comprehensive Action Plan has been prepared and communicated to all the
line departments for taking necessary action on the points pertains to their
departments
through the reference 2nd read above.
3. In the Comprehensive Action plan, among other things it was decided to constitute Shandy Level Monitoring Committee.
4. Accordingly, Government here by Constitute Shandy level Monitoring Committee with the following members
5. If any member or his family member are involved and charged under any ‘Act’ concerning the cruelty to animals or adding or abetting any such act
shall not be included in the above Committee.
6. The Guidelines for functioning & Monitoring of the Committee are as
detailed below:
(i) Shandy Level Monitoring Committee(SLMC)shall ensure provision of ramps, CC cameras, proper arrangements of feeding, Drinking water & shed for animals, GPS in transport vehicles, partition in vehicle as per specification.
(ii) Make arrangements for presence of VAS/A.D for issue of H-form (fitness certificate) and ensure that H-Forms are issued only to the number permitted for that vehicle.
(iii) The SLMC mandatorily make arrangements for the registration of all
the animals owners in the cattle market. Proper record of each & every sale and purchase of animals shall be maintained.
(iv) With an intention to put check on purchase of progeny (calves) for purpose of slaughter, proper identity of seller and Purchaser and records of ownership of land ( Farmer Holding Book) for the proof of having been land owner should be verified by the Committee & record maintained.
(v) The Purchaser of young animal(Progeny)has to submit self declaration at the time of purchase of each & every progeny mandatorily, that he would not sell cattle purchased till its legally permissible age and would use
the cattle for agricultural / Milch/breeding purpose only. If declaration is found to be incorrect, legal action would be taken.
(vi) In the absence of requisite permission under the Andhra Pradesh
Prohibition of Cow Slaughter & Preservation of Animals Act 1977, (Sec
6) the animal cannot be transported out of the State under any
circumstance.
(vii) Address of the purchasers of animals purchased through cattle markets and number of animals purchased be made available to market committee offices mandatorily. In case irregularity is found, then case be registered and information of the action taken be forwarded to the Andhra Pradesh State Animal Welfare Board.
(viii) Before issuing permission of transportation of the animals, all
above mentioned documents be scrutinized by the Police, Transport, Animal Husbandry Department and Panchayat/ Municipal dept. Officers concerned.
(ix) Permission should be given by Market Department Officers to bring cattle/animal at the site of the markets according to the capacity of the market, i.e., holding capacity. Shops may be allowed at the site of animal markets for sale of cattle feed and grass for the animals.
(x) After sale of animals in the market, transport permit is to be issued
in four copies, out of which first is to be handed over to the purchaser, second copy to seller, third copy to the VAS of the Shandy and the fourth and last copy be kept intact in the record by the Department of the Agri marketing /Municipal Dept / Gram Panchayat as the case may be which maintaining the cattle market.
(xi) Seminar, vigilance camps should be organised for the publicity of the various provisions of cruelty towards animals and protection of animals at the sites of cattle markets.
(xii) The SLMC shall submit monthly report to SPCA Chairman (District Collector) and to the State Animal Welfare Board.
7. The Head of the Departments, in the address entry are therefore requested
to communicate the order to all concerned for taking necessary further action
in the matter.
