R:
In the letter read above, the
Chief Commissioner of Land Administration, Telangana State, Hyderabad, has
reported that based on the judgment of the Hon'ble High Court of A.P.,
Hyderabad dt:16-4-2010 in W.P.No.18596/09 and other related judgments, the
seniority of Deputy Tahsildars for the panel year 1980-81 to 2006-07 in the
State was revised, duly pushing down the persons who were promoted against the
direct recruit vacancies and on that basis revised panel of Tahsildars of all
the Zones were also approved by the DPC. In this process some of the persons
got notional date of promotion in the cadre of Tahsildars. Further the Chief Commissioner
of Land Administration, Telangana, Hyderabad, while enclosing the proposals of the following (24) individuals belonging to Zone –V &
VI, along with enclosures, has requested
to issue necessary relaxation orders for fixation of pay notionally in terms of FR.26(aa), duly
relaxing G.R.33(a) of APS&SS Rules, 1996.

2. Government after careful
examination of the matter, have decided to relax General Rule 33(a) of
APS&SS Rules 1996 in respect of individuals mentioned at para ( 1 ) above, and
to fix the pay of the individuals who got notional date of promotion, strictly
in terms of FR 26 (aa), in the scale in which they are eligible, subject to out
come of Court Cases if any pending. It is further decided that the arrears
shall not be payable for the notional duty period as a result of revision of
seniority.
3. Accordingly, Government hereby
accord permission to the Chief Commissioner of Land
Administration, Telangana State, Hyderabad, to fix the pay of the
individuals mentioned at para (1) above, who got notional date of promotion,
strictly in terms of FR 26 (aa), in the scale in which they are eligible, in
relaxation of General Rule 33 (a) of APS&SS Rules 1996, subject to the out
come of Court Cases if any pending. It is further ordered that, the arrears
shall not be payable for the notional duty period as a result of revision of
seniority.
