Postponement of bye-elections Legislative Assemblies of Madhya Pradesh and Jammu & Kashmir respectively



Postponement of bye-elections from 132-Ghoradongari(ST) Assembly Constituency in Madhya Pradesh and 40- Anantnag Assembly Constituency in Jammu & Kashmir to fill vacancies in the Legislative Assemblies of Madhya Pradesh and Jammu & Kashmir respectively – regarding.

The Commission has announced bye-elections from 40- Anantnag Assembly Constituency in Jammu & Kashmir and 132-Ghoradongari(ST) Assembly Consitutuency in Madhya Pradesh to fill vacancies in the Legislative Assemblies of Jammu & Kashmir and Madhya Pradesh respectively vide its Press Note No. ECI/PN/32/2016, dated 19th April, 2016. The date of poll of the bye-elections as announced is 16th May, 2016 and counting is scheduled to be taken up on 19th April, 2016.

The Chief Secretary, Jammu & Kashmir has apprised the Commission that the Law & Order situation of District Anantnag due to certains recent incidents is not conducive at the moment for the holding bye-election from 40- Anantnag Assembly Constituency. He has, therefore, requested the Commission to postpone the bye-election from 40- Anantnag Assembly Constituency for the present.

Similarly, It has been brought to the Commission’s notice by the State Government of Madhya Pradesh that Simhastha Mahakumbh is due to begin on 22nd April, 2016 and would continue for one month up to 21st May, 2016. During this Mahakumbh, over 5 crore pilgrims are expected to visit Ujjain and other holy places in the State, for which huge secureity and logistical arrangements have been undertaken, involving shifting of police forces from various districts to the Mahakumbh areas. It has been further informed that during the Simhastha Mahakumbh an International Philosophic Convention is also being organized from 12-14 May, 2016 at Ujjain District where various VVIPs and other Heads of State- Governments from foreign countries will be attending, for which also police forces will be deployed from other parts of the State due to critical security requirements. Therefore, the entire state administration, including police forces, would be focusing on the smooth conduct of Simhastha Mahakumbh, particularly on logistical and security issues, during the Simhastha period.

Therefore, the State Government of Madhya Pradesh has requested the Commission to postpone the polling and counting by about 10 days for the bye-election from 132-Ghoradongari(ST) Assembly Constituency.

In view of the above situation, the Commission has decided to postpone both the said bye-elections for the present and hereby rescinds its announcement of bye-elections from 40- Anantnag Assembly Constituency and 132-Ghoradongari(ST) Assembly Constituency to the Legislative Assemblies of Jammu & Kashmir and Madhya Pradesh respectively made earlier vide its Press Note No. ECI/PN/32/2016 dated 19th April, 2015. Accordingly, announcement for bye-elections from 40- Anantnag Assembly in Jammu & Kashmir Constituency and 132-Ghoradongari(ST) Assembly Constituency in Madhya Pradesh will be made subsequently.
