2.      The  Principal Secretary to Government (Mines), Industries & Commerce Department shall be the Convenor of the above Group of Ministers.



“Smt. A. Soni Bala Devi, IFS (2002), Project Director, DRDA, Kurnool is transferred and her services are placed at the disposal of General Administration (Vigilance and Enforcement) Department for appointment as Regional Vigilance and Enforcement Officer, Vijayawada vice Sri M. Ravi Kumar, IFS (1999) transferred.  Her deputation shall be governed by the terms and conditions annexed to this order.

2.       On transfer, Sri M. Ravi Kumar, IFS (1999) shall report before the Principal Chief Conservator of Forests (HoFF), A.P., Hyderabad, for further posting.

ORDER:

       In the letter 2nd read above, the Director General of Police, A.P., Hyderabad, has stated that Government vide G.O.Ms.No.116, Home (Pol.E) Department, dated 15.5.2000 issued certain guidelines for transfers and postings of Deputy Superintendents of Police (Civil).  One of the guidelines is that the Inspectors on first promotion to the rank of D.S.P. shall be posted to Greyhounds, APSP Bns., CID, Intelligence, ACB, Training Institutions and Railways only.  After completion of their tenure of minimum 2 years in Grey Hounds, APSP Bns., CID, Intelligence, Railways and Training Institutions, their cases for transfer to Law & Order Sub-Divisions will be considered. 

2.    In view of the following practical problems involved with the above guidelines, the Director General of Police, A.P., Hyderabad, has requested the Government to amend the 2 year tenure of working in Specialized Units in rank of D.S.P. prescribed vide G.O.Ms.No.116, Home (Pol.E) Department, dated 15.5.2000, to one year.
  
i.            Govt. vide G.O.Ms.No.116, Home (Pol.E) Department, dated 15.5.2000 has already fixed a tenure of 2 years as Inspector of Police in any of the Specialized Units within the Department or outside the Department on deputation/tenure other than Law & Order, Crime/Traffic Stations in the Districts/Units before being considered for promotion to the post of D.S.P.

ii.          Including the above period, one is supposed to work for 4 years (ie., 2 years as Inspector and 2 years as D.S.P.) in Specialized Units.

iii.        In view of the permission of the Government vide G.O.Ms. No.77, Home (Ser.I) Department, dated 28.3.2011 that preparation of panel of Deputy Superintendents of Police  fit for promotion as Addl. Superintendent of Police  excepting for not having completed five years of minimum service (3 ½ years), only 1 ½ year will remain to work in Law & Order having worked 2 years in Specialized Units. 

iv.        Thereby, not only they are having sufficient experience in Law & Order before becoming Addl. S.P. but also not in the interest of the Department.

v.          Besides this, if an SDPO is found not suitable to work there, much difficulty being experienced to post a suitable officer in view of shortage of Deputy Superintendents of Police having completed two years in specialized units.

vi.        Moreover, with this existing condition of 2 years most of the promoted Deputy Superintendents of Police are not getting chance of working in Sub Divisions to gain experience in Law & Order by being deprived of their turn as the number of sub divisions are limited. 

3.     The Director General of Police, A.P., Hyderabad, has therefore, requested the Government to amend the 2 year tenure of working in Specialized Units in the rank of D.S.P. prescribed vide G.O.Ms.No.116, Home (Pol.E) Department, dated 15.5.2000 to one year, so that all the Deputy Superintendents of Police working in the Department will have an experience in Law & Order and would be in the interest of the Department as stated above.

4.    After careful consideration of the matter, the Government accept the proposals of the D.G.P., and accordingly hereby reduce the minimum tenure period of 2 years as prescribed in G.O.Ms.No.116, Home (Pol.E) Department, dated 15.5.2000, to one year to work in specialized units of Greyhounds, APSP Bns., CID, Intelligence, ACB, Training Institutions and Railways, in respect of Inspectors of Police on first promotion to the rank of Deputy Superintendent of Police.     

5.    The Director General of Police, A.P., Hyderabad, is requested to take further necessary action in the matter.

ORDER:

The Director General of Police, AP, Hyderabad, in his letter 1st read above has stated that the A.P. Police Communication is running with huge shortage of vacancies right from the rank of Inspectors to PCs(C). The recruitment process remains pending with A.P. State Police Recruitment Board due to administrative reasons.

2.    The DGP, AP, Hyderabad has informed the following vacancy positions including in all categories.
      
Sanctioned strength    -     1844
       Actual Strength           -     1176     
       Vacancies                   -       668

3.    The DGP has further informed that, due to huge shortage the administration is facing acute inconvenience to attend routing duties other than special duties like VVIP B/B etc. There is lack of personnel even for critical and important bandobust duties.

4.    The DGP has also informed that since there are large number of vacancies of Inspectors to PCs (C) in A.P. Police Communications for want of candidates as well as incompletion of Third Phase recruitment process taken up after sanction of 35,831 posts in G.O.Ms.No.281, Home (Ser-III) Department, dated: 20.11.2007, it is very essential to appoint SPOs with a remuneration of Rs.7000/- per month on contract basis.

5.    The Director General of Police, AP, Hyderabad, has, therefore, requested the Government to allocate SPOs for the time being to accommodate technically qualified personnel (Retired from technical posts) in all categories of Police Communications to appoint them as SPOs in the Communication Organization.

6.    Further, the Director General of Police, AP, Hyderabad has stated that the cost involved in the proposal is (50X7000/-X 12) =               Rs. 42,00,000/- per annum in the head of account 2055-Police-MH114 wireless and computers SH (04)- Police Communications and Computer Services.

7.    Government, after careful examination of the matter, hereby accord permission to the Director General of Police, AP, Hyderabad, for hiring (50) Special Police Officers, in Police Communication Organization with a remuneration of Rs.7000/- per month on contract basis, for a period of one year or until the posts are filled up, whichever is earlier, subject to meeting the costs within the approved budget.

2. The individual is not eligible for T.T.A./D.A. as it is a request transfer.

Andhra Pradesh Shops and Establishment Act, 1988 – Splendour Gold Collections Limited Liability Partnership, Hyderabad – Exempted from certain provisions of the Andhra Pradesh Shops and Establishments Act – Orders Issued.

ORDER:
The application of Splendour Gold Collections Limited Liability Partnership, Hyderabad was received along with information in the prescribed formats seeking grant of exemption from Sec 7, 12 and 31 of A.P. Shops & Establishments Act, 1988 to keep open the shops on all 365 days of the year.
2. The proposal of the Splendour Gold Collections Limited Liability
Partnership has been examined and after careful consideration, the Government hereby exempt Splendour Gold Collections Limited Liability Partnership, Hyderabad from the provisions under Section 7 (1), 12 (1) and 31 (1) of the Andhra Pradesh Shops and Establishments Act, 1988, for a period of (2) two years in respect of their (3) outlets (Annexure enclosed) subject to field verification
and confirmation within (3) months and also subject to the conditions stipulated in the Notification.
3. Accordingly, the following notification will be published in the extraordinary issue of the A.P. Gazette:-
NOTIFICATION
In exercise of the powers conferred under sub-section (4) of Section 73 of the Andhra Pradesh Shops & Establishments Act, 1988 (Andhra Pradesh Act 20 of 1988), the Governor of Andhra Pradesh hereby grant exemption to Splendour Gold Collections Limited Liability Partnership, Hyderabad from the provisions of Section 7(1), 12(1) & 31(1) of Andhra Pradesh Shops & Establishments Act, 1988
for a period of two (2) years in respect of their (3) outlets (Annexure enclosed) subject to field verification and confirmation within (3) months and also subject to the following conditions:-
1) The daily working hours of the employee shall be 8 hours and weekly 48 hours. Record of Over Time will be maintained in respect of the employees who work beyond normal working hours, in the Wages
Register, separately.
2) Every employee will be allowed a Weekly Holiday as per the list
exhibited (form 24) at the main entrance of the shop.

3) If the employees found working on any Holiday or after normal duty
hours without proper indent for Over Time, the exemption granted will be liable for cancellation.
4) Working Hours of the Shop shall be between 9.00 A.M to
11 P.M.
5) In case of Women employees who are required to work beyond 8.30 PM., transport arrangements will be provided to the women employees. A notice to this effect in Telugu and English will be exhibited at the main entrance of the shop.
6) All employees will be provided with Appointment Letters and a copy of the same will be furnished to the jurisdiction inspector and
acknowledgment will be preserved in the shop for inspection at any
time.
7) Visit Book will be maintained exhibiting a copy of the exemption for
verification by the Inspector for compliance with the conditions on
exemption.
8) The exemption will be valid for 2 years only and subject to satisfactory compliance with the conditions of exemption and also compliance with the welfare provisions under various Labour Laws, renewal will be considered.
9) The exemption is applicable for only the shop which applied for the
exemption but not to any other shop which has taken sub-lease within
the shop. The lessees also may be directed to obtain exemption, if they so choose.
10) If majority of the workers oppose the exemption on the ground of
violation of labour laws and consequent exploitation, the exemption will be liable for cancellation.
11) The wages for the employees will be credited to their Savings Bank Account.
12) EPF & ESI deductions shall be implemented in respect of the eligible employees.
13) The Employer shall cooperate in implementing the “Duties of Inspection” under Rule 28 of the A.P. Shops and Establishments Rules, 1990 especially with regard to the implementation of the conditions and also the provisions of Other Labour Laws for the workers employed in their Shops.
14) The Exemption will be cancelled before the sanctioned period, if any statutory violation is detected and the Employer of the Shop is held guilty and will not be entitled for refund of the user Chargers paid.

15) The exemption will be for a period of two years from the Date of
notification and unless revoked.

16) Renewal of the exemption for two years will be subject to satisfactory                                                                                                                                                                                                                                                                         compliance with the above conditions.
17) Levy of User Charges of Rs.50,000/- (Rupees fifty thousand only) for all the establishments who are granted exemption from the provisions of A.P. Shops and Establishments Act, 1988.
