O R D E R :

Whereas, by section 101 of the Andhra Pradesh Re-organisation Act, 2014 (Central Act No. 6 of 2014), the appropriate Government i.e. the State of Telangana is empowered by order, to make such adaptations and modifications of any law (as defined in section 2(f) of the

Act) made before 02.06.2014, whether by way of repeal or amendment as may be necessary or expedient, for the purpose of facilitating the application of such law in the State of Telangana before expiration of two years from 02.06.2014; and thereupon every such law shall have effect subject to the adaptations and modifications so made until altered, repealed or amended by a competent Legislature or other Competent Authority; And whereas, it has become necessary to adapt the Andhra Pradesh State Council of Higher Education Act, 1988 and the Rules and Regulations made there under for the purpose of facilitating their application in relation to the State of Telangana; Now, therefore, in exercise of the powers conferred by section 101 of the Andhra

Pradesh Re-organisation Act, 2014 (Central Act No.6 of 2014), the Governor of Telangana hereby makes the following order, namely:-

1. (1) This order may be called the Andhra Pradesh State Council of Higher Education Act, (Telangana Adaptation) Order, 2014.

(2) It shall be deemed to have come into force with effect from 2.6.2014.

2. In this Order, the law i.e. the A.P. State Council of Higher Education Act being adapted in this order shall have the same meaning as defined in section 2(f) of the Andhra Pradesh Reorganisation Act, 2014.

3. The Andhra Pradesh General Clauses Act, 1891 applies for the interpretation of this order as it applies for the interpretation of a State Act.

4. In section 4 of the Andhra Pradesh State Council of Higher Education Act, 1988,-

(1) In section 1, in sub-section(i) for the words “Andhra Pradesh”, the word “Telangana” shall be substituted.

(2) In section 2,-

(a) In clause (c), for the words “Andhra Pradesh”, the word “Telangana” shall be substituted;

(b) in clause (f), for the words “Andhra Pradesh”, the word “Telangana” shall be substituted;

(3) In section 3 in sub-section(i), for the words “Andhra Pradesh”, the word “Telangana” shall be substituted.

(4) In section 4, - in sub-section(1)

(1) under the heading (I) FULL TIME MEMBERS, in item (ii) for the words “two Vice Chairmen”, the words “One Vice Chairman” shall be substituted.

(2) Under the heading ”II EX-OFFICIO MEMBERS,” item (V) shall be substituted with the following:

“(v) The Vice Chancellors of the Osmania University, Kakatiya University, Jawaharlal Nehru Technological University, Telangana University, Mahatma Gandhi University, Palamuru University, Satavahana University.”

(5) In section 16, for the words “Legislative Assembly”, the word “Legislature” shall be substituted.

(6) In section 17, in sub-section(4), for the words “Legislative Assembly”, the word “Legislature” shall be substituted.

(7) In section 22,in sub-section(2), for the words “Legislative Assembly”, occurring at two places, the word “Legislature” shall be substituted.

5. As from the appointed day, the Andhra Pradesh Regulations and Rules mentioned in the Schedule to this Order, shall, until altered, repealed or amended by a competent Legislature or other competent authority, have effect subject to the adaptations and modifications directed by that Schedule.

6. For the purpose of this Order, and the Act, Rules and Regulations adapted herein the expression “the State” shall have the meaning and area as specified in section 3 of the A.P. Reorganisation Act, 2014.

SCHEDULE

[See paragraph(5)] REGULATIONS

1. The Andhra Pradesh State Council of Higher Education (Procedure for the Conduct of Business) Regulations, 1988.

Throughout the order issued in G.O.Ms.No.290, Education (UE) Department, dated 20.7.1988 as amended from time to time and in the Regulations, For the words “Andhra Pradesh” substitute the word “Telangana”.

2. The Andhra Pradesh State Council of Higher Education (Manner of association of Persons with the Council) Regulations, 1988. Throughout the order issued in G.O.Ms.No.291, Education(UE) Department, dated 20.7.1988 as amended from time to time and the Regulations,

For the words “Andhra Pradesh” substitute the word “Telangana”.

RULES

(1) The State Council of Higher Education (Maintenance of Books of Accounts and Auditing of Accounts) Rules, 1988.

(2) The State Council of Higher Education(Deposit of Funds)Rules, 1989.

(3) The State Council of Higher Education(Annual Financial Statement) Rules, 1989.

(4) The State Council of Higher Education(Funds of the Council and release of grants-in-aid to University and Institution) Rules, 1989.

(5) The A.P. State Council of Higher Education (conditions of service of Chairman, Vice-chairman and other Members) Rules, 1988.

(6) The A.P. State Council of Higher Education (Conditions of service of the Secretary), Rules, 1988.

(7) The A.P. State Council of Higher Education Service Rules, 1993.

(8) The A.P. State Council of Higher Education (Discipline, control and appeal) Rules, 1991.

In the said Rules as amended from time to time, for the words ”Andhra Pradesh” the word “Telangana” shall be substituted.

NOTIFICATION
In exercise of the powers conferred by Section 5 (1) of the Telangana State Council of Higher Education Act, 1988, the State Government of Telangana hereby appoint Prof. Tummala Papi Reddy (Retd), Department of Economics, Kakatiya University, Warangal as the Chairman of Telangana State Council of Higher Education for a term of three years.

The following Notification shall be published in the Extra-ordinary issue of the Telangana State Gazette dated: 05-08-2014.

NOTIFICATION
In exercise of the powers conferred by sub-section (1) of section 3 of the Telangana.State Council of Higher Education Act, 1988 as adapted to the State of Telangana vide G.O second read above, the State Government of Telangana hereby constitute a State Council to be called as the “Telangana State Council of Higher Education” w.e.f. 05-08-2014.

2. The Telangana State Council of Higher Education shall be a body corporate having perpetual succession and a common seal and shall sue and be sued by the said corporate name.

3. In all suits and other legal proceedings by or against the State Council the proceedings shall be signed and verified by the Secretary and all processes in such suits and proceedings shall be issued to and served on the Secretary.

4. The headquarters of the Council shall be located at Hyderabad.

5. (1) The State Council shall consist of the following members namely:-

I. FULL TIME MEMBERS
(i) a Chairman, and
(ii) One Vice-Chairman
To be appointed by the Government from among eminent
educationalists:

II. EX-OFFICIO MEMBERS:
(i) The Secretary to Government, Education Department:
(ii) The Secretary to Government, Finance Department:
(iii) The Secretary to Government, Labour, Employment and
technical Education:
(iv) Secretary or any other Officer of the UGC not below the rank of Joint Secretary nominated by the Chairman, UGC.
(v) The Vice-Chancellors of Osmania University, Kakatiya
University, Jawaharlal Nehru Technological University,
Hyderabad, Telangana University, Mahatma Gandhi University, Palamuru University, Satavahana University, ,

III. OTHER MEMBERS
(i) Four persons to be appointed by the Government from among eminent educationists
(ii) One Person who shall represent the Industry to be appointed by the Government.
(iii) Three persons of whom one shall be a technical expert, to be nominated by the State Government
6. Every appointment under this Section shall take effect from the date on which it is notified by the Government.
