Where as, in the G.O. 1 st read above, orders were issued appointing
the Additional Director General of Police, Crime Investigation Department,
Andhra Pradesh or Inspector General of Police, C.I.D., as the “Competent
Authority” under sub-section (1) of section 4 of the Andhra Pradesh
Protection of Depositors of Financial Establishments Act, 1999 (Andhra
Pradesh Act.No.17 of 1999) to exercise control over the properties
attached by the Government under section 3 of the said Act.;
2.  And whereas, in the reference 2 nd read above, the Addl. DGP, CID,
A.P., Hyderabad has informed that, Sri Avva Venkata Rama Rao and five
others established M/s Agri Gold Farms & Estates India Pvt Ltd, Vijayawada
and registered the same under the companies Act, 1956(Central Act No. 1
of 1956) 46 vide No.U45309 AP 2001 PTC 038237 in the year 1995. They
had collected deposits and offering higher rates of interests besides real
estate operations and construction. It has done its business in the states
of Andhra Pradesh, Telangana and Karnataka. In the recent times, the
company was not paid the refunds to the depositors nor registered any
land on the depositors’ names. Cheques issued by the company towards
refunds have been dishonoured by the respective Banks;
3.  And whereas, based on the complaints of aggrieved depositors,
several complaints have been registered at various Police Stations across
the State of Andhra Pradesh. On the directions of the Government two
cases in Cr.No.378/2014 U/s 120-B, 406, 420 of the IPC and section 5 of
the Andhra Pradesh Protection of Depositors of Financial Establishments
Act, 1999 of Nellore-III Town PS, Nellore District and Cr.No.3/2015, u/s
120-B, 420 of the IPC, section 0 of RBI Act & section 4 of Price Chit and
Money Circulation Scheme( Banning) Act 1978 section 5 Andhra Pradesh
Protection of Depositors of Financial Establishments Act, 1999 of
Peddapadu Police Station West Godavari District have been transferred to
CID in the month of January, 2015 for further investigation;
4.  And  whereas,  the  Addl.  Director  General  of  Police,  Crime
Investigation Department, Andhra Pradesh, Hyderabad has requested the
Government to issue an ad-interim orders for attachment of certain
movable properties listed in the Annexures-I to VI belonging to A2, A3 and
A1 as per section 3 of the Andhra Pradesh Protection of Depositors of
Financial Establishments Act, 1999, in order to protect the interest of the
depositors of such financial establishments;
5.  The Government have examined the matter carefully in the light of
the provisions of the Andhra Pradesh Protection of Depositors of Financial
Establishments Act, 1999(Act No.17 of 1999) and hereby pass an ad-
interim order under section 3 of the said Act, for attachment of certain
movable properties standing in the name of M/s Agri Gold Farms & Estates
India Pvt Ltd. and its Directors as shown in the Annexures-I to VI to this
order.
The competent Authority and the Addl. Director General of Police,
Crime Investigation Department, Andhra Pradesh, Hyderabad is requested
to take necessary further action in the matter accordingly as per the
provisions of the said Act and Rules made thereunder, following due
procedure and report compliance to Government.

    Order in the matter of M/s Agri Gold Farm Estates India Private Limited (AGFEIPL) and its Directors

    Shri S Raman, Whole Time Member, SEBI, has passed an interim order dated February 05, 2015 in the matter of
    M/s. Agri Gold Farm Estates India Private Limited and its directors under Sections 11(1), 11(4) and 11B of the
    Securities and Exchange Board of India Act, 1992 read with Regulation 65 of the Securities and Exchange Board of
    India (Collective Investment Schemes) Regulations, 1999 and Securities And Exchange Board Of India (Prohibition
    Of Fraudulent And Unfair Trade Practices Relating To Securities Market) Regulations, 2003.

    The Registered Office of the Company is situated at Agri Gold Towers, H.No. 6-3-680/A/B, Thakur Mansion Lane,
    Near Somajiguda Circle, Hyderabad- 500082. The order directed the company and its Directors, viz., Mr. Venkata
    Rama Rao Avva, Mr. Avva Venkata Seshu Narayana Rao, Mr. Avva Hema Sundara Vara Prasad, Mr. Savadam
    Srinivas, Mr. Moganti Bhanuji Rao and Mr. Emmadi Sada Siva Vara Prasad Rao, not to collect any fresh money
    from the investors under its existing schemes, not to launch any new schemes or plans or float any new companies
    to raise fresh moneys, to immediately submit the full inventory of the assets including land obtained through money
    raised by AGFEIPL, not to dispose of or alienate any of the properties/assets obtained directly or indirectly through
    money raised by the company, not to divert any funds raised from public at large which are kept in bank account(s)
    and/or in the custody of AGFEIPL and to furnish all the information/details sought by SEBI within 15 days from the
    date of receipt of the order.

    The Company was engaged in fund mobilizing activity from public by floating/sponsoring/launching
    unregistered/unauthorized Collective Investment Scheme (CIS) as defined in section 11AA of the SEBI Act, 1992.
