ORDER:
The State Government is taking the Central Civil Service Officers viz.
IRAS/IRTS/IRPS/IRS/IDES/IPoS etc. on deputation at the request of the Officers
duly obtaining the concurrence of the parent Ministry in Central Government to
which the officer belongs after ascertaining that the Officer is free from vigilance
angle. In the unified State of Andhra Pradesh, Sri Kaviti Muralikrishna filed a public
interest litigation petition by way of W.P. No. 22240 of 2009 before the Hon’ble High
Court and the Hon’ble High Court directed the State Government to formulate the
guidelines for deputation of Central Civil Service Officers to State Government.
2. After careful examination of the matter, the Government hereby issue the
following criteria / guidelines for taking the Central Civil Service Officers on
deputation to State Government.
i)  A Committee, consisting of Prl. Secretary to Govt., and one officer
nominated by the IAS Officers’ Association and the Principal
Secretary to Govt. (Poll) may be formed, who will go through the
excess ex-cadre posts being utilized in three services and identify
certain posts where the services of a deputationist is required. After
this is approved by the Government, the posts may be filled up
through Officers taken on deputation from the Central Civil Services.
ii)  The Committee shall consider the request of the Central Civil Service
Officers only on administrative exigencies, keeping in view the post
required to be filled in is of such a nature and an expertise, which is
not available amongst the State Officers.
iii)  The Committee may meet whenever there is a request from any
Officer / Officers and decide whether he/they may be taken on
deputation and whether he/they will fit into one of the posts identified.
iv)  The Committee will take into consideration the qualification,
experience etc. of the deputationist for manning the post so
identified.
v)  The Central Civil Service Officers taken on deputation shall not be
posted to a cadre post in any of the All India Services.
vi)  The State Government shall transfer these Officers only to other
posts within the identified earmarked for deputationists of Central
Civil Service Officers duly keeping in view his expertise to man the
post.
vii)  The Committee will also examine whether the Officer seeking
deputation is free from vigilance angle before the request is
considered.
viii)  The Committee may evolve any other norms or guidelines for
consideration of the applications of Central Civil Service Officers for
deputation to State Government.
