transporters JAC.

06-2015.
4) G.O.Rt.No.1915, General Administration (Cabinet) Dept., Dt.25-
06-2015.
5) Minutes of the meeting of cabinet sub-committee (CSC) held on
30-06-2015 with Transporters JAC.

ORDER:

         Government vide G.O.Rt.No.1907, GA(Cabinet) Dept., Dt.24-06-2015
issued orders constituting the Cabinet Sub-Committee (CSC) with the
following Ministers to look into the grievances of the Transporters JAC:

a) Hon’ble Deputy Chief Minister for Home, Disaster Management.

b) Hon’ble Minister for Finance & Planning, Commercial Taxes, Legislative
Affairs.

c) Hon’ble Minister for Transport, Roads and Buildings.

d) Hon’ble Minister for Labour & Employment, Factories, Youth & Sports,
Skill Development and Entrepreneurship.

2. The Special Chief Secretary to Government (CT, Excise and Regn.&
Stamps) was named as convener of the CSC.

3. Further, the Government had set out the points for consideration of
the CSC vide G.O.Rt.No.1915, G.A.(Cabinet) Dept., Dt.25-06-2015.

4. The CSC after detailed deliberations with the representatives of the
Transporters JAC and the Officers of the Dept. concerned made certain
recommendations for redressal of the grievances of the Transporters JAC.
Government, after carefully examining the matter, hereby approve the
following recommendations of the CSC:

Issues of Commercial Taxes Dept.
Waiver of lease tax on oil tankers from 8-11-2011
Exempting the transporters from filing declarations in forms 650 & 651 at
the check posts
Removal of lorries from the black-list in cases of non-submission of transit
passes at the exit check-posts on the border between AP and Telangana.

Recommendations of the CSC.
The VAT (lease tax) levied from 8-11-2011 till date may be waived and the
future taxes are to be collected from the oil companies by deducting the tax
at source from the bills payable to the oil tankers. Suitable provisions to be
made. The transport lorries carrying single load goods will not be insisted for
declarations and those vehicles carrying multiple goods belonging to
multiple dealers only have to submit declarations The Commissioner of Commercial Taxes (CCT) has already removed such lorries from the list. No further action is required.

Issue of Civil supplies Dept.
Abolition of form-F and form-B licenses for petrol bunks under Essential
Commodities Act.

Recommendation of the CSC
Recommended that licenses once issued will be made valid for the life
period without insisting on renewal.

Issue of Fire Services Department
Withdrawal of court notices issued to the petrol bunks by the Fire Services
Department for not complying with the prescribed fire safety norms.

Recommendation of the CSC
The fire services department may examine the issue and submit necessary
proposals to Government on shifting the burden of complying with the fire
safety norms to petroleum companies instead of retail operators.

Issue of Municipal & PR Departments
Stoppage of collection of ‘aseel’ (Octroy) from the transporters from local
contractors in municipal and panchayat areas

Recommendation of the CSC
The MA&UD and PR Departments have already issued instructions to ensure
that no ‘aseel’ is collected in their limits. Recommended to the departments
to ensure compliance of those instructions.

Issues of Transport Department
i. Suspending the driving license of transport lorry drivers involved in
accident cases only after proper enquiry but not on the basis of FIR filed
by the Police.
ii. Prevent over-loading in transport vehicles,

Recommendation of the CSC
The CSC recommends that in cases of accidents involving deaths of
passengers the existing Rules are to be complied with. In other cases the
department should submit appropriate proposals to Government.

Police Department
Granting station bail for the drivers involved in accidents.
Preventing Police Officials from checking the offence of over-loading in
transport vehicles

Recommendations of the CSC
The CSC recommends that in cases of accidents involving deaths of
passengers the existing Rules are to be complied with. In other cases the
department should submit appropriate proposals to Government.
The CSC, after being informed that the Police have no authority to check
over load lorries, recommended that compliance to earlier instructions not
to resort to such checks by the Police Dept. should be ensured.

5) All the Departments concerned are hereby directed to take further
necessary action immediately on the recommendations of the Cabinet Sub-
Committee (CSC).
