ORDER
In the reference 1st read above under section 20 read with section 21 of the Micro Small Medium Enterprises Development Act 2006 (Central Act No.27 of 2006) the State Government have constituted the Andhra Pradesh Micro and Small Enterprises Facilitation Council for a period of two years.
2) In the reference 2nd read above, the Andhra Pradesh Micro and Small Enterprises Facilitation Council Rules, 2007 were issued
3) In the reference 4th read above, the Commissioner of Industries, Hyderabad, has stated that the term of the above committee expired on 14.3.2011 and requested to issue necessary orders for extension of the term of the Andhra Pradesh Micro and Small Enterprises Facilitation Council (APMSEFC) for a further period of 2 years with effect from 15.3.2011. In the reference 5th read above, the term of Andhra Pradesh Micro and Small Enterprises Facilitation Council (APMSEFC) was constituted with same members for another two years with immediate effect
4) In the absence of specific provision in the Micro, Small and Medium Enterprises Development Act, 2006 (Central Act No. 27 of 2006)or in the Andhra Pradesh Micro and Small Enterprises Facilitation Council Rules, 2007, the term of the Council can not be extended beyond two years. However, as per the proviso to rule 3 (iii) of the National Board for Micro, Small and Medium Enterprises Rules, 2006 issued by the Ministry of Small Scale Industries, Government of India, a member shall be eligible for reappointment. 
5) The Government after careful examination have decided to have a provision for re appointment of a member of the Andhra Pradesh Micro and Small Enterprises
Facilitation Council and accordingly Andhra Pradesh Micro and Small Enterprises Facilitation Council Rules, 2007 have to be amended, suitably. 
6) Accordingly, the following notification shall be published in the extraordinary issue of the Andhra Pradesh Gazette dated: 16.08.2012.

                                N O T I F I C A T I O N
In exercise of the powers conferred by section 30 of the Micro, Small and Medium Enterprises Development Act, 2006 (Central Act 27 of 2006), the Government
of Andhra Pradesh hereby makes the following amendment to the Andhra Pradesh Micro and Small Enterprises Facilitation Council Rules, 2007 issued in G.O.Ms.No.52, Ind. & Com. (SSI-A2) Dept., dt:15.3.2007 and as subsequently amended.

                                    A M E N D M E N T
“In the said rules, after clause (C) of sub-rule (3) of rule-3, the following shall be added namely:-
“provided that a member shall be eligible for re-appointment”.
