R D E R:-
The following
Notification will be published in an Extra-Ordinary issue of Andhra Pradesh
Gazette dated 14th August, 2012:-
NOTIFICATION
Whereas, the
Organization known as Communist Party of India (Maoist) whose avowed
object is to overthrow the lawfully established Government by means of force
and violence and through terrorist activities, involving the use of fire arms and
explosives, landmines, claymore mines and rocket launchers and whereas, its
front organization, namely, Revolutionary Democratic Front (RDF)
formed with the merger of All India People’s Resistance Forum
(AIPRF) and Struggling
Forum for People’s resistance (SFPR) in May 2005, is a part of Tactical United
Front, has been indulging in the following unlawful activities, namely,-
(1) Sub serving
the interest and objectives of the Communist Party of India (Maoist)
whose avowed objective is to over throw the lawfully established
Government by means of force and violence through terrorist
activities involving the use of firearms and explosives;
(2) Urging
people to fight against the Police and join the Maoist movement;
(3) Opposing
and demanding stoppage of anti extremist combing operations of
the police and security forces in the left wing extremism affected area
of the States and there by abetting and encouraging the violent
activities of Maoist;
(4) Organising
dharnas, rallies and other forms of agitations in support of the unlawful
activities of the Communist Party of India (Maoist) and
(5) Opposing
lawful actions of police and criminal justice system and inciting the people
to take violence against the democratically elected government
established by law. And whereas,
the Government are of the opinion that for the reasons aforesaid, the
associate, namely, Revolutionary Democratic Front (RDF), interferes with
the administration of the law and upsetting the maintenance of public order
constituting a danger to the public peace and thereby qualify to be declared as an
unlawful association. And whereas the
Government are of the further opinion that because of the activities
of the said associate, it is necessary to declare Revolutionary Democratic
Front (RDF), as unlawful with immediate effect.
Now, therefore, in exercise of the powers conferred by sub section (1) of section 3 of the Andhra Pradesh Public Security Act, 1992 (Andhra Pradesh Act 21 of 1992), the Government of Andhra Pradesh, hereby, declare the Revolutionary Democratic Front (RDF) a front organization of Communist Party of India (Maoist) as an unlawful association.

NOTIFICATION
WHEREAS, the
Government had issued a notification in G.O. Ms. No. 372,
General Administration (SC.A) Department, dated the 17th August, 2005, and
published in the Andhra Pradesh Gazette No. 608, dated the 17th August, 2005,
declaring the All India Revolutionary Students
Federation (AIRSF),
a front organization of Communist Party of India (Maoist), as
an unlawful
association for a period of one year with effect on and from the 17th August, 2005 initially under sub-section
(1) of section 3 of the Andhra Pradesh Public
Security Act, 1992 (Andhra Pradesh Act No. 21 of 1992); And WHEREAS, on
the opinion of the Advisory Board constituted under
sub-section (1) of section 5 of the said Act, the Government had issued a
notification in G.O. Ms. No. 502, General Administration (SC.A) Department,
dated the 11th November, 2005, and published in the
Andhra Pradesh Gazette
Part-1, Extraordinary issue No. 780-A, dated the 12th November, 2005,
confirming the notification declaring the All India
Revolutionary
Students Federation (AIRSF), a front organization of Communist Party
of India (Maoist), as an unlawful association; And WHEREAS,
the Government have further extended the period of notification
issued in the Government Order first read above declaring the
activities of
the association as unlawful from year to year, in the G.Os third to eighth read
above under sub-section (4) of section 3 of the said Act. The last
notification was issued in G.O.Ms.No.482, General Administration (SC.A)
Department, dated the 9th August, 2011, and published in the Andhra Pradesh
Gazette No.445, dated the 12th August,
2011, declaring the
All
India Revolutionary Students Federation (AIRSF), a
front organization of
Communist Party of India (Maoist), as an unlawful association,
which expires on 16.08.2012; AND WHEREAS,
the Government have reviewed the matter and are of the opinion
that the All India Revolutionary Students
Federation (AIRSF)
is continuing to indulge in unlawful activities specified in
the notification
issued in G.O. Ms. No. 372, General Administration (SC.A)
Department,
dated the 17th August, 2005 and its unlawful activities,
if not stopped, will
constitute a serious danger and menace to public order, peace and
tranquility;
NOW, THEREFORE,
in exercise of the powers conferred by subsections (1) and (4) of
section 3 of the Andhra Pradesh Public Security Act, 1992 (Andhra
Pradesh Act No. 21 of 1992), the Government of Andhra Pradesh hereby
declare the All India Revolutionary Students Federation

and its unlawful activities, if not stopped, will constitute a serious danger
and menace to public order, peace and tranquility;
NOW, THEREFORE,
in exercise of the powers conferred by subsections (1) and (4) of

Pradesh Act No. 21 of 1992), the Government of Andhra Pradesh hereby

Party of India (Maoist), as an unlawful
association, which expires on 16.08.2012; AND WHEREAS the
Government have reviewed the matter and are of the opinion
that the Communist Party of India (Maoist) is continuing to indulge in
unlawful activities specified in the notification, issued in G.O. Ms. No. 366,
General Administration (SC.A) Department, dated the 17th August, 2005
and its unlawful activities, if not stopped, will constitute a serious danger
and menace to public order, peace and tranquility;
NOW, THEREFORE, in exercise of the powers conferred by subsections (1) and (4) of section 3 of the Andhra Pradesh Public Security Act, 1992 (Andhra Pradesh Act No. 21 of 1992), the Government of Andhra Pradesh hereby declare the Communist Party of India (Maoist) as an unlawful association for a further period of one year with effect on and from the 17th August, 2012.
