Sri V.Dinesh Reddy, I.P.S. appointed as Dierctor General of Police
Sri V. Dinesh Reddy, IPS was appointed as Director General
of Police, A.P., Hyderabad in the Government order 1st read above.
Aggrieved by the said appointment Sri
P. Gautam Kumar, IPS, challenged the said appointment by filing O.A. No. 678 of
2011 before the Central Administrative Tribunal, Hyderabad. Hon’ble C.A.T., in
its order dated 19.6.2012 set aside the selection and appointment of Sri V.
Dinesh Reddy, and directed the state Government to forward the names of all
eligible officers in the HAG+ Scale as on the date with all their service
records to the Union Public service Commission with necessary requisition for
preparation of a panel as directed by the Hon’ble Supreme Court in para 31 (2)
of Prakash Singh’s case within one week.
2. Government
appealed the matter before the Hon’ble High Court by filing W.P. No. 19026 of 2012.
This W.P., filed by the Govt. of A.P., was dismissed by the Hon’ble High Court
on 16.8.2012 with the following direction:
(i)
Apropos the operative directions issued by the
Tribunal in the order impugned herein (para 45), the appellant – The State of
Andhra Pradesh shall forward the names of all eligible and serving Police
Officers in the rank of DGP in the HAG + Scale together with their entire
records of service to the UPSC, requesting preparation of a panel, as directed
by the Supreme Court in the paragraph 31.2 of the judgment in Prakash Singh v.
Union of India, within one week (7 days), from the date of receipt of a copy of
this judgment;
(ii)
Within two weeks from the date of receipt of
proposals from the State Government (forwarded by the State in conformity with
direction (i) supra), the UPSC shall draw up a panel as directed in para 31.2
of the judgment in Prakash Singh and communicate the same to the State of
Andhra Pradesh. This direction is issued
to the UPSC (though not a party to this lis) since UPSC’s obligation to empanel
officers for appointment to the post of DGP (HoPF) arises from the judgment of
the Supreme Court in Prakash Singh;
(iii)
Within one week (7 days) from the date of receipt of
the panel forwarded by the UPSC, as set out in the preceding direction, the
State Government shall select one of the three senior-most officers (empanelled
by the UPSC), for appointment to the post of DGP (HoPF), in compliance with the
directions in Prakash Singh; and

Since the order of the Tribunal setting aside the
appointment of Sri V. Dinesh Reddy, as DGP (HoPF) is being upheld by this Court
herein, in the public interest, we direct that till the process of a fresh and
lawful appointment to the post of DGP (HoPF) is executed in accordance with the
foregoing directions, Sri V.Dinesh Reddy, may discharge the functions of the
DGP (HoPF), but as a purely incharge / officiating arrangement. The officer shall neither be entitled to nor
draw salary and emoluments attached to the post of DGP (HoPF). He would however be entitled to draw salary
and emoluments to the post of DGP in HAG+Scale.
3. The State Government filed Special
Leave Petition before the Hon’ble Supreme Court and in compliance with the
interim directions of the Hon’ble Supreme Court dated 24.8.2012 in Special
Leave Petition (C) No. 25106 /2012, the State Government has forwarded the
names of eligible IPS officers in the Director General of Police HAG+Scale
together with the entire service records as required by the Union Public
Service Commission with a request to prepare a panel and forward to the State
Government.
4. The Union Public Service Commission in
its letter 6th read above has forwarded the Minutes of the
“Empanelment Committee for preparation of a panel for appointment to the post
of Director General of Police (Head of Police Force) Andhra Pradesh” taking
into account the range of experience of officers in the core areas of policing like
law and order maintenance, crime investigation, administration etc., along with
experience in the fields of vigilance / intelligence / crime.
5. Government after taking into account
the recommendations of the Union Public Service Commission and after due
consideration of the service records and range of experience of the three
officers empanelled by the Union Public Service Commission decided to select Sri V.
Dinesh Reddy, IPS to the post of Director General of Police, Andhra Pradesh,
Hyderabad.
6. Accordingly, in supercession of the
orders issued in the G.O. 6th read above, it is hereby notified that
Sri V. Dinesh Reddy, IPS is appointed to the post of Director General of
Police, (Head of the Police Force), Andhra Pradesh, Hyderabad in the Apex Scale
of Rs.80,000+0, with immediate effect.
