O R D E R
In the G.Os. 1st to 3rd read above, Government have accorded permission to dispose off 4160 MTs of Red Sanders by e-tender cum e-auction in the first spell out of permitted quantity i.e., 8584.1363 MTs by engaging MSTC for conducting sale of Red Sanders by e-tender cum eauction and by appointing Andhra Pradesh Forest Development Corporation Limited as export agency and sale proceed realisation agency for disposal of Red Sanders.

 2. In the reference 4th read above, orders were issued to the effect that after confirmation of highest bids by the Government, the MSTC Ltd., would disclose the names of the highest bidders and they will be informed about confirmation of sale and direction to pay 25% of the bid amount within (10) days of confirmation and to enter into agreement with Andhra Pradesh Forest Development Corporation Ltd. Remaining amount of 75% shall be paid within (30) days of
confirmation of sale as already approved under special terms and conditions. Further, both 25% and 75% of the sale amount have to be remitted to the account of Andhra Pradesh Forest Development Corporation Ltd., by the purchaser for proper accounting in place of existing arrangement of 25% payment to MSTC Ltd., and 75% to Andhra Pradesh Forest Development Corporation Ltd. The MSTC Ltd., would transfer pre-bid deposit and additional pre-bid deposit
to the Andhra Pradesh Forest Development Corporation Ltd., after confirmation of sale by the Government.

 3. In partial modification to the orders issued in the references 1st to 4th read above Government hereby order that Andhra Pradesh Forest Development Corporation Ltd., will issue demand notice to the successful bidders for remitting sale proceeds and taxes there on. On issuance of such demand notice, the purchaser shall deposit the sale proceeds and taxes payable to State Governmentinto the following Account:

 4. Andhra Pradesh Forest Development Corporation shall ensure transfer of pre-bid deposits received by MSTC directly to the Government into the above account after deducting service charges payable to MSTC as ordered in the reference 2ndread above after confirmation of sale by the Government. In respect of remittance by international bidders,Andhra Pradesh Forest Development Corporation shall issue mandatory export related certificates to State Bank of India
to facilitate receipt of inward remittance to the said account.


(a)    “The MSTC shall transfer pre bid deposits and additional pre bid deposits to the APFDC. The additional pre bid deposit shall be converted as performance deposit which shall be released to the concerned after completion of contract as per the terms and conditions of Red Sanders sale agreement”

5. After receipt of proceeds into the above account, State Bank of India shall deposit the proceeds into the following Head of Account: 
0406 - Forestry and Wild Life
 01 - Forestry
101 - Sale of Timber and Other Forest Produce
SH(10) - Receipt from Red Sanders

 6. In the G.O. 3rd read above, Andhra Pradesh Forest Development Corporation Ltd., has beenappointed as Export Agency and sale proceed realisation agency and is permitted to charge commission to the extent of 2% of the sale proceeds subject to the maximum of Rs.5.00 Crores. 

 This Commission will be drawn and paid to the Andhra Pradesh Forest Development Corporation Ltd., on completion of the process and the expenditure is debitable to the following Head of Account.

ORDER:
            In the G.O. read above, orders were issued for remittance sale proceeds of Red Sanders by e-tender cum e-auction and taxes there on. The APFDC has been appointed as Export Agency and sale proceed realisation agency. The agency is permitted to charge commission to the extent of 2% of the sale proceeds as subject to the maximum of Rs.5.00 Crores. 

2.         In the 2nd read above, the VC&MD , A.P. Forest Development Corporation Limited has requested to issue  an amendment and clarifications on the points mentioned therein.
3.         Government after careful examination issue the following amendment to the said G.O.
AMENDMENT
The following shall be incorporated after para 4 of G.O.1st read above
(a)    “The MSTC shall transfer pre bid deposits and additional pre bid deposits to the APFDC. The additional pre bid deposit shall be converted as performance deposit which shall be released to the concerned after completion of contract as per the terms and conditions of Red Sanders sale agreement”

4.         The VC&MD, A.P. Forest Development Corporation Limited shall take necessary action accordingly.
