ORDER
In the letters first and third read
above, the Director of Ports, GoAP, Kakinada has reported that M/s Kakinada Sea Ports Ltd
have started the development of 7th berth contiguous
to the 6th Berth and accordingly furnished the
drawings and designs in respect of construction of 7th berth for approval.
2. In this regard and as per the
orders of the Government vide Memo 2nd read above, the
Director of Ports has referred the
designs and drawings furnished by M/s.Kakinada Sea Ports Ltd to M/s.RITES Ltd with a request to
review and analyze the designs and drawings based on latest relevant codes for marine and
concrete structures and furnish the designs review report covering the structural and functional aspects.
3. Accordingly, M/s.RITES Ltd have
reviewed the designs and drawings and communicated the design review report vide letter 4th read above and informed that the design review report covers the review of designs for 298.15 m of 7th berth submitted by M/s.Kakinada Sea Ports Ltd. M/s.RITES Ltd have also informed that the design
review reveals that the 298.15 m of 7th berth is designed
as per the latest standards and satisfy
the design requirements for handling the design vessel.
4. The Director of Ports while
enclosing the detailed design review report for 298.15 m of
7th berth, furnished
by M/s.RITES, has requested the Government for approval subject to
implementation of recommendations
made by the consultant M/s.RITES.
5. Government after careful
examination of the matter is hereby approve the detailed design review report furnished by
M/s.RITES Ltd towards construction of 7th berth of 298.15
m contiguous to 6th berth by
M/s.Kakinada Sea Ports Limited, subject to condition that the recommendations
made by the consultant M/s.RITES Ltd shall
be implemented.
6. The Director of Ports, GoAP,
Kakinada is requested to take necessary further action in the
matter.

ORDER
In the letter first read above, the
Director of Ports, GoAP, Kakinada has furnished the
proposals of pending applications
in respect of allotment of Kakinada Port lands on long lease basis for placing the same before the
committee, re-constituted for allotment of Kakinada Port lands in the G.O. 2nd read above.
2. In the reference 3rd read above,
the committee re-constituted for allotment of Kakinada Port lands has recommended to consider
the cases of conversion of annual licence into long lease in respect of 23 firms subject to
obtaining their willingness for payment of lease charges as per G.O.Ms.No.571, Revenue (Assn.I)
Department, dt 14-09-2012.
3. Accordingly the Director of
Ports, GoAP, Kakinada has been requested to obtain and submit the willingness of the applicants
in the Memo 4th read above and in response, the Director of Ports vide reference 5th read above has stated that all the applicants have expressed their
unwillingness for payment of lease amounts as per
G.O.Ms.No.571, Revenue (Assn.I) Department, dated 14-09-2012 and hence he has proposed that the
applications for conversion from annual licence to long lease be considered subject to their
acceptance of the lease rentals fixed by the Government.
4. The Director of Ports, GoAP,
Kakinada while furnishing fresh proposals consisting of 16 firms as mentioned below for conversion
of annul licence to long lease with certain terms and conditions, has requested the Government for
approval, as the said firms are paying lease rentals regularly and they are carrying out business,
putting lands to use as allotted to the firms on Annual Lease basis and they are paying at the existing
rates in force at present as per G.O.Ms.No.2, I&I (Ports.I) Department, Dt.09-01-2009;

5. In view of the circumstances
explained by the Director of Ports, GoAP, Kakinada and after careful examination, Government
hereby approve the proposal of the Director of Ports, GoAP, Kakinada for conversion of annual
licence into long lease in respect of 16 firms as mentioned in para (4) above with the existing lease
rentals, subject to the following terms and conditions;
i. All the firms/individuals who
were permitted for conversion of annual licence into long
lease should furnish undertaking
that:
a. They will abide to the
enhancement of lease rentals and pay the lease charges as
revised from time to time by the
Government during the period of lease and the
agreement is liable for
cancelation, if they do not agree to pay the enhanced rent when
so demanded and they will not
approach any court of jurisdiction for relaxation of lease
rentals in future what so ever
fixed by the Government.
b. They will abide to the terms and
conditions of the Land policy for allotment of Govt.
Port lands of A.P. Port Department
as and when approved by the Government.
ii. The firms/individual shall
enter into 30 years lease agreement with the Director of Ports
in the prescribed proforma.
iii. The Director of Ports. GoAP,
Kakinada is authorized to enter into 30 years lease
agreement with the firms/individual
under intimation to Government.
iv. The lease will be cancelled in
case the land is not utilized for the purpose for which it
is allotted within 3 years, or if
the lease holder defaults on lease rental payments, or if
the lease holder infringes with any
lease provisions.
6. Government have decided to
constitute a Committee to recommend fixation of lease rentals for the lands being allotted on
long lease basis at Kakinada Port and orders in this regard will be issued separately.
7. The Director of Ports, GoAP,
Kakinada shall enter into long lease agreement with the
firms/individuals, under intimation
to Government.
8. This order issues with the
concurrence of Finance Department vide their U.O.No.086/A3/FMUI& I, EF&MA/2015., dated
28-10-2015.

In the G.O. 3rd read above, Government have re-constituted the Committee., constituted
in the G.O.s 1st and 2nd read above to scrutinize all applications of
firms/organization for
allotment of Kakinada Port lands on
long lease basis to maintain total transparency, with the following members:

2. In the G.O.4th read above, orders were issued allotting Kakinada Port lands to certain
firms of annual licence on long
lease basis with the following terms and conditions
i. All the firms/individuals who
were permitted for conversion of annual licence into
long lease should furnish undertaking
that:
a. They will abide to the
enhancement of lease rentals and pay the lease charges as

Government during the period of lease and the
